一、甲為居住於宜蘭縣蘇澳鎮之自耕農，於 112 年 5 月 1 日年滿 65 歲。依據老年農民福利津貼暫行條例，年滿 65 歲以上者得請領該津貼。甲遂向 其所屬農會申報，經主管機關審查合格後發給其老年農民福利津貼（下 稱老農年金）。114 年 1 月 1 日某報紙報導甲的配偶乙，自述其配偶甲出生時由於戶政事務所作業疏失誤填出生年月日，甲將於 114 年 5 月 1 日度過 65 歲 生日。見報後，即有鄉民向縣政府檢舉，甲過去兩年應該沒有資格領取老農年金，因此主管機關打算向其追討過去誤發的老農年金，試問應如何為之？但甲認為其非常無辜，因為有錯的不是他，是戶政事務所，而 且發下來的錢都已經拿來繳交房租了，請問甲的說法有無理由？（25 分）
