一、甲經營砂石堆置場，該堆置場作業程序領有原處分機關核發固定污染源 操作許可證。主管機關於民國(下同)115 年 1 月 15 日 11 時許，派員 至該堆置場外之另外一筆土地查核，此土地坐落於「特定農業區農牧用 地」管制使用土地上，在未向農業單位申請許可的前提下，前述該員發 現甲於系爭土地上堆置砂石混合物。經現場測量砂石混合物堆置量超出 原限定的 3,000 立方公尺，原應另依規定申請取得固定污染源設置及操 作許可證，甲卻逕行設置與操作，違反空氣污染防制法之規定。因此遭 主管機關裁罰新臺幣 32 萬元罰鍰，並限期於 115 年 5 月 31 日前完成改 善。甲主張，其已受到區域計畫法主管機關依法認定其行為違反了區域 計畫法之規定而對之進行裁罰，如此形成其同時收到「空氣品質」與「土 地使用」之行政管制的處罰。甲認為前述原處分機關之裁罰已然違反一 行為不二罰之原則。試問：甲之主張是否成立？(25 分) 參考條文： 空氣污染防制法第 24 條：I. 公私場所具有經中央主管機關指定公告之固定污染源，應於設置或變更前，檢具 空氣污染防制計畫，向直轄市、縣(市)主管機關或中央主管機關委託之機關申請 及取得設置許可證，並依許可證內容進行設置或變更。 II. 前項固定污染源設置或變更後，應檢具符合本法相關規定之證明文件，向直轄 市、縣(市)主管機關或經中央主管機關委託之機關申請及取得操作許可證，並依核發之許可證內容進行操作。 區域計畫法：第 15 條第 1 項：區域計畫公告實施後，不屬第十一條之非都市土地，應由有關直轄市或縣(市)政府，按照非都市土地分區使用計畫，製定非都市土地使用分區圖， 並編定各種使用地，報經上級主管機關核備後，實施管制。變更之程序亦同。其管 制規則，由中央主管機關定之。第 21 條第 1 項：違反第十五條第一項之管制使用土地者，由該管直轄市、縣(市) 政府處新臺幣六萬元以上三十萬元以下罰鍰，並得限期令其變更使用、停止使用或 拆除其地上物恢復原狀。

二、甲為某國立大學教授，經由該校提出申請書並列報近 5 年研究成果向國 家科學及技術委員會(下稱國科會)申請獲准擔任其所補助專案研究計 畫主持人。嗣經國科會審查甲所列之近 5 年研究成果中 2 篇論文部分內 容雷同，卻未引註，涉有違反學術倫理之情事，經國科會提交學術倫理 審議會認定屬實，構成「國科會學術倫理案件處理及審議要點」第 3 點 第 4 款規定之違反學術倫理情形，國科會乃依同要點第 12 點規定，對 甲予以停權 1 年，停權期間不得申請及執行國科會各項補助及獎勵案件， 並通知甲。甲有所不服，認為國科會依據之審議要點所作出之決定，有 牴觸依法行政原則之疑義。試問：審議要點之性質為何？甲之主張是否 成立？(25 分)
