二、作文：(40 分) 題目：一個令人慶幸的選擇 人生由不斷作出的選擇串接起來，成就了現在的你我。台灣是民主社會，大 眾的選擇經常透過民調或選舉展現出來。亞馬遜創辦人貝佐斯曾對大學畢業生致詞時提到：「聰明是天賦，而善良是選擇。」請以「一個令人慶幸的選擇」為題，先說明貝佐斯此言之意，並提出你認為作選擇應該依據的最重要原則，再結合個人經驗見聞與觀察體悟，寫一篇首尾完整的文章，文長不限，唯不得使用詩 歌體。

二、甲為 A 大學助理教授，於 114 學年度第 1 學期申請升等為副教授。 依 A 大學規章之規定，助理教授申請升等為副教授，須研究、教學、 服務三個項目成績皆達 70 分以上，始為通過。因甲教學、服務項目之成績在系教師評審委員會（下稱教評會）與院教評會審查階段皆超過 70 分，院遂將其升等案送校教評會審查，並由學校就甲之升等著作辦理外審程序。甲之升等著作經送三位校外學者專家審查之結果， 其成績分別為 72 分、78 分、80 分。惟校教評會最終審議甲之升等案時，卻以外審委員乙對甲之代表著作評價偏低，與其他外審委員意見不同，另學生丙對於甲之教學有負面評語之理由，而不通過甲之升等 案，並由學校作成處分通知甲。甲認為校教評會不應再針對其研究項目進行評分，且其無視絕大多數學生對其之正面評語，原處分違法。 試問：甲之主張是否有理由？請附具理由說明之。（25 分）

一、市民甲在網路上選購外國產製尚未入關商品，遂依賣家乙之銷售說明，委 託丙業者辦理快速通關手續，甲於進口人欄位填上自己姓名後，雖發現申請系統欄位上自動顯示之進口貨名，並非購物平台展示商品之名稱，但為求儘快取得貨品，享受開箱樂趣，於是點按確認鍵送出，並收到申報完成訊息，未料事後被海關裁罰。試問：海關如何依行政程序法之相關規定， 判斷關稅之納稅義務人？本案何人應承擔海關緝私條例規定虛報所運貨物名稱之法律責任？（25 分）

二、海關對於罕見進口之貨物進行查價時，發現進口人申報之價格，顯然不可採信，且無類似進口案例可參考，而海關又不具認定該貨物品質之專業， 而必須詢問專業人士提供意見時，為求慎重遂找兩家互不認識之相關業者詢價，結果回報價格卻有極大之高低落差，試問海關依據行政法上之原則， 應如何核定該進口貨物之價格？（25 分）
